It’s also worth noting that there has been some confusion circulating that when you use Equifax’s tool to see if you were hacked that you automatically give up your rights to pursue legal action against Equifax. Equifax clarified their fine print language and will allow users to pursue legal action. This is their statement from September 10: “To confirm, enrolling in the free credit file monitoring and identity theft protection products that we are offering as part of this cybersecurity incident does not prohibit consumers from taking legal action.”
